Terms and Conditions

• User: means you, or another person named by you who is authorized to incur charge/change to your Account.
• APP: applies to Gotek Plus™ mobile application which includes your G+™ wallet that holds your NFT Number.
• Gotek Plus™: is a brand owned and operated by Gotek Telecom LTD, including its websites and mobile applications, to make Gotek Telecom LTD’s telecom and communication services accessible. https://gotekplus.com
• NFT Number: Your international Number based on a NFT QR Code. You will send and receive calls on this number of your choice upon purchase.
• G+™ Wallet: is a telecom wallet belonging to Gotek Telecom LTD for the use of the telecom and communication services offered by Gotek Plus™.
• Referral Program: is a reward program offered by Gotek Plus™ services that lets you refer another user using your referral code.
• Fees: includes but not limited to, Network Charges, purchasing your NFT Number, recharging your NFT number.
• Messaging: sending text messages chat between users holding an account.

Thank you for using Gotek Plus™, a mobile application that provides telecom communication and messaging services using high end Blockchain security. Gotek Plus™ offers communication and telecom services of calling and receiving calls on an international NFT number. The application also offers text messaging. These terms and conditions (“Terms”) govern your use of our APP. By using our APP, you agree to these Terms. If you do not agree to these Terms, do not use Gotek Plus™ APP and its services.

These terms and conditions may be amended by Gotek Telecom LTD at any time. Where such amendments are made Gotek Telecom LTD will provide the amended terms and conditions on the website. If there is any inconsistency between these Terms and Conditions and the details of any request and/or order made by you for the purchase of Gotek Plus™ Products and/or Services then these terms and conditions will prevail to the extent of such inconsistency.

The user or the user’s representative must be 18 years of age or older to order Gotek Smart Watch through the Website. By placing an Order, the user or the user’s representative acknowledges that he or she is 18 years of age or older.

Different versions of Gotek Plus™ may emerge or alter due to obsoletion / upgrades / updates. Use of Gotek Plus™ services includes any associated hardware, mobile application, or websites. Gotek Telecom LTD has the right to change, update, upgrade features as it sees fit without prior notice to the user.

Gotek Telecom LTD may modify or suspend the online services (Gotek Plus™ mobile app), wholly or partially, without notice where such modification or suspension is deemed necessary by us (e.g., for maintenance, upgrading, security, emergency or other valid reasons) or by an authorized authority. All reasonable efforts shall be made to minimize such Service disruptions; however, some interruption may be inevitable. We will notify you were and as soon as it is practicable to do so.

Our APP is for personal and non-commercial use only. You may use our APP only for lawful purposes and in compliance with these Terms.

To use our APP, you must create an account and Purchase an NFT Number. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account or password.

User must accept these terms and conditions in order to create or use Gotek Plus™ products and services. If you do not accept these terms and conditions, you will not be able to use Gotek Plus™ products and services. In order to use Gotek Plus™ mobile app you must and purchase Gotek Plus™ NFT Number. To register and purchase NFT Number you need to enter your full information and details.

User holds full responsibility of their purchases of NFT Number and recharging G+™ wallet, and being connected to the internet to make and receive calls, or to use text messages. Gotek Telecom LTD is not held responsible for your local country’s communication and telecommunication laws, you should be aware of your country’s laws and regulations, or any charges incurred from using the internet connection whether you’re using WiFi or from your local GSM provider. You should be connected to the internet to use Gotek Plus™ mobile app and its services.

We will charge fees for certain features of our APP, including but not limited to, Purchasing NFT Numbers, Recharging Credits, Network Fees. By using these features, you agree to pay any APP applicable fees. All fees are non-refundable.

Our APP and its contents, including text, graphics, images, and other materials, are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or otherwise use any part of our APP without our prior written consent.

User holds full responsibility for all activity and use/misuse of your account, including the distribution and sharing of your account credentials. Gotek Telecom LTD doesn’t hold the responsibility of any misuse or data changes that occur in the user account by the user.

Our APP may allow you to submit content, such as comments, photos, and other materials. By submitting content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, distribute, and display the content in connection with our APP.

You agree to use our APP in compliance with applicable laws and regulations, and not to engage in any prohibited activities, including:

• Engaging in any unlawful activities, including money laundering, terrorist financing, or any other activities that violate applicable laws and regulations.
• Using our APP to commit fraud or deceive other users.
• Attempting to gain unauthorized access to any user’s account or any portion of our APP.

You may not use our APP to:

• Violate any APP applicable law or regulation
• Infringe any intellectual property rights or other proprietary rights of us or any third party
• Upload, post, or transmit any content that is unlawful, defamatory, obscene, or otherwise objectionable
• Engage in any conduct that is disruptive or harmful to our APP or other users.

If User is facing any issues regarding the account on Gotek Plus™ mobile app, you may communicate with Gotek Plus™ support team to resolve the issue soonest possible through the appropriate support channels https://gotekplus.com/support/ or by sending a support ticket from the support section on Gotek Plus™ mobile app. To provide appropriate support you should consent to providing appropriate information and data about your usage and interaction with Gotek Plus™ mobile app and its services; this may include your NFT Number, name, email, phone number, etc. Please refer to the Privacy Policy for more information.

Our Gotek Plus™ APP is provided “as is” and “as available.” We do not make any warranties, express or implied, regarding Gotek Plus™ APP or its contents, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event will we be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our Gotek Plus™ APP, including any damages resulting from lost profits, lost data, or business interruption.

You agree to indemnify and hold us harmless from and against any claims, damages, liabilities, and expenses arising out of or in connection with your use of our APP or your violation of these Terms.

These Terms are governed by and construed in accordance with the laws of Canada. Any disputes arising out of or in connection with these Terms will be resolved exclusively in the courts of Canada.

We may update these Terms from time to time, and we will make available of any material changes by posting the updated Terms within our APP or Gotek Plus™ website, with no prior notification.

We may terminate your account or your access to our APP at any time, with or without cause. User has the full right to delete the account and all Gotek Smart Watch Data associated with that account. To do so, user has to send an email to support@gotekplus.com or the support link https://gotekplus.com/support/ to submit the request and consent to do so.
